Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Rural Capital, LLC, a Texas limited liability company ("we," "us," or "Company"), governing your access to and use of the Findurance application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Service Description

Findurance is a personal finance forecasting tool that helps users project future account balances based on income, expenses, and other financial data they provide.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• All information you provide is accurate, current, and complete.
• You will maintain the accuracy of your information.

4. Account Registration & Security

To use certain features of the Service, you must create an account. You may register using an email address and password, or through a third-party OAuth provider (such as Google), as facilitated by our authentication service.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Subscription Plans

Findurance offers a free tier with core forecasting functionality. Paid subscription tiers with additional features may be introduced in the future.

If and when paid plans are offered:

• Pricing, features, and billing terms will be communicated before you are charged.
• We reserve the right to modify pricing with reasonable notice.
• Detailed billing, cancellation, and refund terms will be provided at the time paid plans launch.

6. User Data & Content

You retain ownership of all data and content you provide to the Service ("User Data"). By using the Service, you grant us a limited, non-exclusive license to process, store, and display your User Data solely for the purpose of operating and improving the Service.

We do not claim ownership of your financial data. See our Privacy Policy for details on how we handle your information.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
• Scrape, crawl, or use automated means to access the Service without our express written permission.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or the servers and networks used to provide it.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service to transmit any viruses, malware, or other malicious code.

8. Intellectual Property

The Findurance name, logo, and all related branding, software, designs, text, and other materials (excluding User Data) are the property of Rural Capital, LLC and are protected by applicable intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service or its content beyond the limited right to use the Service as described herein.

9. Third-Party Services

The Service integrates with or relies on third-party services, including:

• Supabase — for user authentication and data storage.
• Plaid (future) — for optional bank account connections and transaction imports, when available.

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the practices of third-party service providers.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Forecasts or projections generated by the Service will be accurate or reliable.
• Any defects in the Service will be corrected.

Financial projections are estimates based on data you provide. Actual results will vary. Do not make financial decisions based solely on Findurance forecasts.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RURAL CAPITAL, LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Rural Capital, LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of any third party.
• Any User Data you provide to the Service.

13. Termination

You may stop using the Service at any time. You may request account deletion by contacting us at info@findurance.app.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through an in-app notification. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Texas.

16. General Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rural Capital, LLC regarding the Service.

Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
